H.R. 9495: A Threat to Nonprofits, Communities, and Marginalized Populations

Nonprofits are the lifeblood of our communities, providing essential services, advocating for equity, and uplifting marginalized populations. Yet, the recently proposed H.R. 9495, known as the "Kill Nonprofits Bill," could jeopardize the critical work we do every day. While the legislation may be well-intentioned in its goal to curb terrorism financing, it introduces severe risks that could harm the very communities we strive to serve.


This bill threatens due process, donor trust, and the availability of essential services for vulnerable populations. It’s time to sound the alarm and demand better solutions that protect nonprofits while addressing legitimate concerns about misuse of nonprofit organizations.


Nonprofits Are Vital to Community Well-Being


Nonprofits like Wings Advocacy exist to fill critical gaps in our social safety net. Whether we’re providing housing supplies to families experiencing homelessness, helping survivors of interpersonal violence, or delivering humanitarian aid in crisis zones, nonprofits are indispensable. Our ability to operate depends on trust—from donors, the communities we serve, and the public at large. H.R. 9495 threatens this trust by introducing unnecessary, punitive measures that could stifle our work.


The Dangers of H.R. 9495


While preventing the misuse of nonprofits to fund terrorism is an essential policy goal, H.R. 9495 introduces severe problems:


1. Redundancies and Confusion:

The bill adds overlapping regulations to existing anti-terrorism laws, creating unnecessary administrative burdens. For small nonprofits with limited resources, this could result in compliance challenges that distract from their missions.


2. Erosion of Due Process:

Section 4 of the bill allows the Treasury Secretary to designate nonprofits as “terrorist-supporting organizations” with little transparency. Accused nonprofits would have only 90 days to prove their innocence, a burden that violates constitutional protections and undermines the principles of justice.


3. Harm to Vulnerable Communities:

Nonprofits working in conflict zones—where aid is most urgently needed—are at particular risk. Losing tax-exempt status due to unproven accusations could force these organizations to cease operations, cutting off critical assistance to marginalized populations.


Who Suffers the Most


If passed, H.R. 9495 would disproportionately impact vulnerable communities, including:

- People experiencing homelessness, who rely on shelters, advocacy, and housing services.

- Survivors of interpersonal violence, who depend on nonprofits for safe housing, counseling, and essential resources.

- Displaced individuals in conflict zones, who count on humanitarian aid for food, water, and medical care.


These populations cannot afford for nonprofits to be weakened or sidelined by burdensome regulations and baseless accusations.


What's the Status of HR 9495?


As of November 12th, the House of Representatives blocked H.R. 9495. Because the House of Representatives was attempting to move the bill on suspension it required a two-thirds majority in order to pass. However, bills moved on suspension can be re-voted on. A Call to Action


We need thoughtful policies that stop bad actors without punishing legitimate, life-saving nonprofits. H.R. 9495 is not the solution. It risks silencing organizations that advocate for justice and equity while leaving the most vulnerable populations without essential services.

Hi, my name is [Your Name], and I’m a constituent from [City/State]. I’m calling to urge you to oppose H.R. 9495, the Stop Terror-Financing and Tax Penalties on American Hostages Act, if and when it is voted on again.


[if they voted for it] I am disappointed that you voted in favor of this harmful bill and your vote does not represent my wishes or interests.

This bill poses a direct threat to nonprofits by granting the Treasury Secretary unchecked power to label organizations as “terrorist supporting” and strip their tax-exempt status. Even worse, this can happen without evidence, intentional links, or any requirement to disclose the reasons for the designation. The lack of due process and accountability leaves nonprofits defenseless against vague and potentially politically motivated accusations.

While the bill includes provisions for tax relief for American hostages—a noble cause—this should not come at the expense of jeopardizing nonprofit operations and democratic values. These provisions should be separated into their own bill that doesn’t include the unchecked harm to nonprofits. 

Please oppose H.R. 9495 to protect nonprofits and the communities they serve. Thank you for your time and consideration.
